Procedure For Registering A Trademark
March 14th, 2010 by Andy BrownA trademark is a type of intellectual property right that safeguards a person’s or a corporate entity’s rights over their brand names and logos. For legal enforcement of trademarks, they have to be duly certified with the suitable authority. This registration not only gives legal approval to the use of a trademark but also serves as an announcement of the trademark’s existence to other companies so that they are deterred from using it for personal gains.
It is advisable to get your brand name registered as soon as you have decided upon it. Any delay in filing an application might result in someone else applying for that name before you, in which case you will lose the opportunity to register that trademark.
The first step towards registration of a brand name requires a basic check on the availability of the name that you wish to register. You must undertake an elaborate search for similar trademarks duly registered by other companies to ascertain any chance of duplication. For this purpose you can use the database of the relevant authority.
The next thing you have to do is to procure a registration form and duly fill it up with the correct details of your company, products manufactured or services offered, the office address and other details asked for. These details then have to be deposited with the authority, usually by paying an application fee. However, you must keep in mind that if you fail to do the needed check, then your application will not be accepted and your application fee will also be forfeited.
After your are done with these formalities, you might be required to reply to certain questions from the authorities. Such questions are required to be answered within a limited time. In case your application is accepted, the authorities will provide you with a certificate stating the necessary details of your trademark that will confer you all legal rights over your trademark along with authority to prosecute an offender for infringement.
